Lincoln knew that he could not free the slaves in the south under the constitution, however he was able to free them under his powers as Commander-in-Chief in a time of war. Lincoln saw that the confederates were using slaves to aid in their war effort and therefore was able to classify them as contraband. This in turn justified emancipation as a military necessity.
